Please read these terms carefully before using our services
1. Introduction
Harrington Bookshop (hereinafter "Harrington Bookshop" or "the Company") is a registered company in Malaysia and provides its website and services subject to the following Terms and Conditions. By accessing our website or purchasing our products (including via third-party marketplaces), you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our site or services. We reserve the right to update or modify these terms at any time by posting the revised Terms on our website, and such changes will be effective from the date of posting. It is your responsibility to review the Terms periodically for updates.
2. Use of Website and Account
2.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. If you are under 18, you must obtain consent from a parent or legal guardian.
2.2 Account Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
2.3 Prohibited Conduct
You agree not to misuse the website. This includes refraining from any fraudulent activities, intellectual property infringement, transmitting any malicious code, or engaging in any conduct that would violate applicable laws or regulations. We reserve the right to terminate or suspend your access if you violate these terms.
3. Products and Orders
3.1 Product Descriptions
Images on the site are for illustration purposes; actual products may vary slightly (especially for refurbished items which may have minor cosmetic wear). Such cosmetic differences that do not affect functionality are not considered defects under our warranty. All products are intended for standard consumer use, not for resale or commercial heavy-duty use unless expressly stated.
3.2 Pricing
All prices are listed in Malaysian Ringgit (MYR) by default, and include any applicable Malaysian taxes unless stated otherwise. For international orders, prices do not include any customs duties, import taxes, or fees applicable in the destination country. You are responsible for all such charges. We reserve the right to adjust prices or run promotions at our discretion; any such changes will not affect orders already placed.
3.3 Order Process
When you place an order, you are making an offer to purchase the selected product(s) under these Terms. We reserve the right to accept or reject any order at our discretion. For example, we may refuse or cancel any order due to errors in pricing or stock availability, suspicion of fraud, or other legitimate reasons. If we cancel an order after you have made payment, we will provide a full refund of the amount paid. You may be required to provide additional information to verify your order (such as proof of identity or billing information) before we finalize the sale.
4. Payment
Payment must be made in full at the time of order (unless a specific installment plan or alternate arrangement is offered by us in writing). We accept the payment methods as displayed at checkout (such as credit card, debit card, online banking, etc.). All payments are processed through secure third-party payment gateways; we do not store your full payment card details on our systems for security. The charge on your statement will be from Harrington Bookshop or our payment processor. If your payment is declined or not received, we reserve the right to cancel the order. Any applicable currency conversion fees or bank charges for international payments must be borne by the customer.
5. Shipping & Delivery
5.1 Territory
We ship both within Malaysia and internationally. Available shipping options and fees will be presented at checkout. Delivery times are estimates and commence from the date of shipment, not the date of order. We strive to fulfill orders promptly, but actual delivery can be affected by factors outside our control (e.g. courier delays, customs clearance, public holidays).
5.2 International Shipping
For international shipments, customers are responsible for any customs duties or taxes imposed by the destination country. Our international shipments are typically sent Delivery Duty Unpaid (DDU), meaning any import duties or fees must be paid by the recipient. If you refuse to pay required import taxes or refuse delivery, the package may be returned to us or disposed of by authorities; in such case we reserve the right to deduct any return shipping fees or customs charges incurred from any refund due, or to deny a refund if the item is abandoned. Please check your country's import rules before ordering.
5.3 Risk of Loss
Title to and risk of loss for products pass to the customer upon delivery to the address provided. This means that once delivered, you bear the risk for the product. If an item is lost or damaged in transit before it reaches you, please contact us and we will work with the courier to resolve the issue. We insure shipments where possible, but we are not liable for delivery delays or failures that are outside our reasonable control (e.g. customs delays, courier mishandling, natural disasters).
5.4 Delivery Failure
If a delivery fails because you provided an incorrect address or were unavailable to receive the package, we will attempt to assist in arranging re-delivery (additional charges may apply). If the item is returned to us as unclaimed or due to incorrect address, we can resend it upon your payment of new shipping fees. If you prefer to cancel in such a case, it may be treated as a return (see Refund Policy) subject to applicable fees for shipping and handling.
6. Product Warranty
6.1 Warranty Coverage
We stand behind the quality of our products. All new and refurbished products sold by Harrington Bookshop come with a standard 3-month limited warranty from the date of delivery, covering defects in materials and workmanship. This means that if a device fails due to a manufacturing defect within 3 months of purchase, we will, at our option, repair the item or replace it with an equivalent unit at no charge, or offer a refund if a repair or replacement is not feasible.
6.2 Warranty Limitations
This warranty covers only defects or malfunctions that arise during normal intended use of the product. It does not cover any damage or issues caused by the user or external events, including but not limited to accidental damage, misuse, unauthorized modifications, cosmetic wear, or improper operating environment. If a returned product is found ineligible for warranty service, the claim will be rejected and the item may be returned at your cost or offered for paid repair/replacement. The warranty is non-transferable and applies only to the original purchaser.
7. Returns & Exchanges
7.1 Return Policy
Except as expressly provided under our Refund Policy or as required by law, all sales are final. We only accept returns/exchanges for products that are defective or not as described upon delivery, in accordance with our warranty obligations. We do not accept returns or exchanges for reasons such as change of mind, order error on the customer's part, or dissatisfaction with the product where no actual defect is present.
7.2 Return Process
For any return of a defective or incorrect item, you must contact us to obtain return authorization and instructions. Unauthorized returns may be rejected. Returned items should include all original accessories and preferably the original packaging. If a returned product is found not defective or inconsistent with your claim, it will not be eligible for refund and will be sent back to you.
8. Third-Party Marketplace Sales
8.1 Marketplace Terms
In addition to our own website, Harrington Bookshop may sell products through third-party marketplace platforms (e.g. Shopee, Lazada, Amazon, eBay). When purchases are made via those platforms, the transaction is also governed by the respective marketplace's terms and policies. You should review those rules as they may differ from ours.
8.2 Warranty Application
However, our 3-month product warranty and these Terms & Conditions still apply to products purchased through authorized third-party channels (unless otherwise stated). Returns/refunds must usually be initiated through the marketplace's system. Harrington Bookshop is not liable for obligations or guarantees beyond our warranty but will comply with marketplace rules as required.
9. Limitation of Liability
9.1 Disclaimer of Warranties
Except as expressly provided in our 3-month limited warranty or required by law, Harrington Bookshop disclaims all other warranties, express or implied.
9.2 Force Majeure
Harrington Bookshop shall not be liable for any failure or delay caused by events outside our reasonable control (e.g. natural disasters, government actions, strikes, pandemics).
9.3 Liability Limitation
To the maximum extent permitted by law, Harrington Bookshop shall not be liable for indirect or consequential losses (loss of profits, data, business opportunities, etc.). Our aggregate liability is limited to the purchase price paid for the product in question.
10. Indemnification
You agree to indemnify and hold harmless Harrington Bookshop, its directors, officers, employees, and agents, from any claims, losses, or expenses arising out of your breach of these Terms, violation of law, or infringement of third-party rights.
11. Governing Law & Dispute Resolution
These Terms shall be governed by Malaysian law. Disputes shall be subject to the exclusive jurisdiction of Malaysian courts. If you are a consumer outside Malaysia, mandatory local consumer rights still apply. We encourage contacting us first for amicable resolution.
12. Miscellaneous
12.1 Severability
If any provision is found unenforceable, the remaining terms remain valid.
12.2 No Waiver
Failure to enforce any provision is not a waiver of rights.
12.3 Entire Agreement
These Terms & Conditions (together with our Privacy and Refund Policies) constitute the entire agreement between you and Harrington Bookshop.
